Please read these Terms of Service ("Terms") carefully before using Pulpit Swap. By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Pulpit Swap, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use our service.

2. Description of Service

Pulpit Swap is a platform that facilitates connections between pastors and religious leaders who wish to temporarily exchange pulpits and accommodations. We provide a venue for users to discover and communicate with potential swap partners. We do not participate in, arrange, or guarantee any swap arrangements between users.

3. Eligibility

To use Pulpit Swap, you must:

  • Be at least 18 years old
  • Be a pastor, minister, or religious leader (or authorized representative)
  • Provide accurate and truthful information
  • Have the authority to offer your pulpit and/or accommodations for a swap

4. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete information in your profile
  • Conducting your own due diligence before agreeing to any swap
  • Obtaining any necessary permissions, insurance, or approvals for swaps
  • Complying with all applicable laws and regulations
  • Your interactions and arrangements with other users

5. User Conduct

You agree NOT to:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Use the service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the platform for commercial purposes unrelated to pulpit swaps
  • Scrape, collect, or harvest user data

6. No Verification of Users

IMPORTANT: Pulpit Swap does not verify the identity, credentials, background, or claims of any user. We do not conduct background checks, verify employment, confirm religious credentials, or validate any information provided by users. You are solely responsible for evaluating and verifying any user before engaging in a swap arrangement.

7. Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT:

  • Meeting strangers involves inherent risks. By using Pulpit Swap, you acknowledge that interacting with and meeting other users, staying in their homes, and allowing them into your home carries risks including but not limited to theft, property damage, personal injury, and other harm.
  • You assume all risks associated with your use of the platform and any interactions, communications, or arrangements with other users, whether online or in person.
  • You are responsible for your own safety. We strongly recommend taking precautions such as: video calls before agreeing to swaps, checking references, verifying church affiliations, informing others of your plans, securing valuables, and obtaining appropriate insurance.
  • Pulpit Swap is not responsible for the conduct, actions, or omissions of any user, whether online or offline.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Pulpit Swap, its owners, operators, employees, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service.
  • This includes, without limitation, damages for: personal injury, property damage, theft, loss of data, loss of income, emotional distress, or any other damages arising from your interactions with other users or any swap arrangements.
  • We are not liable for any failure of users to honor swap arrangements, the condition of any accommodations, the quality of any preaching or religious services, or any disputes between users.
  • Our total liability to you for any claims arising from or related to the service shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pulpit Swap, its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the service, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) your swap arrangements or interactions with other users.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Dispute Resolution

Disputes Between Users: Pulpit Swap is not responsible for resolving disputes between users. Any disputes arising from swap arrangements are solely between the users involved.

Disputes With Pulpit Swap: Any dispute arising from these Terms or your use of the service shall be governed by the laws of the State of Hawaii, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Honolulu, Hawaii.

12. Termination

We reserve the right to suspend or terminate your account at any time, for any reason, without notice. You may delete your account at any time. Upon termination, your right to use the service ceases immediately. Sections 6-11 of these Terms shall survive termination.

13. Intellectual Property

The Pulpit Swap name, logo, and all related content are the property of Pulpit Swap. You retain ownership of content you post but grant us a license to use, display, and distribute your content in connection with the service.

14. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pulpit Swap regarding your use of the service.
